
Services at Your Work/Home
A person
of at
least 18 years of age must be present when services are provided by
CADNY
Computer Services. A CADNY Computer Services agent must receive full
access to
the product(s) to be serviced, access to your residence, your consent
and
cooperation to enter your residence or business, and a safe working
environment, working space and electrical power. A safe working
environment includes the area being smoke free; if smoking is allowed
inside the home it must be aired out sufficiently prior to CADNY's
arrival. Services may be denied and a
one hour labor charge ($60), plus travel if applicable, will be
assessed if a CADNY Computer Services agent
arrives at the scheduled service time and determines that no adult is
present
or that the CADNY Computer Services agent does not reasonably have the
appropriate access, cooperation, or safe working area. CADNY Computer
Services
may refrain from providing any services on the basis that the minimum
system
requirements are not met or the technical needs (including wiring or
overcoming
physical or technical barriers) or other requirements are unusual or
extensive
as reasonably determined by CADNY Computer Services.
Back-Up Your Data
It is your responsibility to back up all software and data on your computer's
hard drive(s) and/or any other storage devices before a CADNY Computer Services
agent arrives. CADNY Computer Services shall not be responsible at any time for
any loss, alteration, or corruption of any software, data, or files.
Warranty
CADNY Computer Services guarantees repair services provided for 30 days.
If there is an issue related to the original problem and if you notify us at 707-825-7264
within the 30-day time period, CADNY Computer Services will work to remedy the
problem quickly and at no additional cost. Custom built CADNY Computers have a
limited parts and labor warranty of 3 years - ask for details.
Software
CADNY Computer Services may install software on your computer that allows
you to obtain additional technology services.
EULAs
For software installations, CADNY Computer Services may accept End User License
Agreements on your behalf.
Loss or Damage
If any damage or loss occurs with respect to your product while in CADNY
Computer Services’ possession or control, regardless of causation or fault, you
are only entitled to repair or replacement of the product.
Ed Gordon May Be Called Away
CADNY owner Ed
Gordon is on call 24 hrs for the Humboldt State University Police Department
and the HSU Emergency Operations Center; in the unlikely event of a UPD
technical or EOC actual emergency occurring while he is performing a service or
repair for a CADNY client, he may have to stop whatever he is doing and leave
immediately – possibly leaving the CADNY client’s computer inoperable until he
can return.
Estimates
An estimate as required (Section 9844 of California Business and
Professions Code) for repairs shall be given to the customer by the service
dealer in writing, and the service dealer may not charge for work done or parts
supplied in excess of the estimate without prior consent of the customer. Where
provided in writing, the service dealer may charge a reasonable fee for services
provided in determining the nature of the malfunction in preparation of a

Limitation of Remedy
To the extent
permitted by law, you agree that CADNY Computer Services’ total liability for
damages related to its services is limited to the total amount you pay for the
services, and you release CADNY Computer Services from liability for any
indirect, incidental, special, or consequential damages. CADNY COMPUTER
SERVICES IS NOT LIABLE FOR LOSS, ALTERATION, OR CORRUPTION OF ANY DATA OR LOSS
OF ANY MEDIA FROM YOUR PRODUCT.
